South Korea’s Supreme Court to review martial law

South Korea’s Supreme Court will review whether President Yoon Seok-yeol’s martial law declaration complied with procedures.

According to The Korea Herald, South Korea’s Supreme Court President Cho Hee-dae told reporters on Wednesday (December 4) that the Supreme Court will review the procedures followed by President Yoon Seok-yeol when he declared martial law on Tuesday night (3rd), and affirmed that the judiciary will “unwaveringly perform its duties during challenging times.”

“The judiciary will ensure its role as the ultimate protector of citizens’ rights and freedoms, and will work to alleviate any concerns about judicial independence and integrity,” Cho said.

When asked whether Yoon Seok-yeol’s declaration of martial law was procedurally irregular, such as whether it was approved by the cabinet before declaring martial law or whether proper notification was given to senior government officials, Cho said the judiciary would “observe what procedures were followed” so that it could deal with the matter later.

Regarding whether Yoon Seok-yeol’s sudden declaration of martial law would be grounds for impeachment, Cho said: “I will deal with this issue at the appropriate time.”

Six hours after the declaration of martial law, the opposition Democratic Party said early Wednesday that its lawmakers would demand Yoon Seok-yeol’s resignation or take impeachment measures.

“The duty of the judiciary is to protect the freedom and rights of citizens through fair judgments, and the (Grand Court) will do its utmost to ensure that there are no omissions in the performance of this duty,” Cho said.

The Grand Court is South Korea’s highest court, composed of the president and 13 justices. Cho took office as president in December last year.
