ICC Judges Sue Trump Administration to Lift Illegal Sanctions

HA Viewpoint: A significant legal battle has erupted between the International Criminal Court (ICC) and the US government. According to reports from AFP and Reuters, three judges from the ICC filed a lawsuit against President Trump and his administration on the 24th, alleging that the sanctions imposed on them last year were illegal.

In a 66-page complaint filed in a New York court, Judges Prosper (Canada), Bosa (Uganda), and Alapini-Gansou (Benin) argued that the sanctions were intended to “apply extralegal pressure” with the goal of punishing and coercing the judges. “Imposing such severe sanctions on international judges is unprecedented,” the document states. The trio is demanding that the sanctions be lifted immediately.

AFP notes that the lawsuit lists not only Trump but also several key administration officials as defendants, including Secretary of State Rubio, Treasury Secretary Bessent, Acting Attorney General Todd Blanch, and Bradley Smith, head of the Office of Foreign Assets Control (OFAC).

As of now, the US State Department, Treasury, and White House have not immediately responded to requests for comment regarding the lawsuit, according to Reuters.

The AFP report highlights that the Trump administration has sanctioned at least 11 ICC officials, including the Court’s Chief Prosecutor. The penalties include travel bans and asset freezes. These measures are widely seen as direct retaliation against the ICC’s investigation into one of America’s key allies, Israel.

On November 21, 2024, the ICC issued arrest warrants for Benjamin Netanyahu, Yoav Gallant, and Hamas military commander Mohammed Diab Ibrahim Al-Masri, accusing them of crimes against humanity and war crimes.

Following this, on February 6, 2025, President Trump signed an executive order declaring that the US would sanction the ICC, citing “illegal and unfounded actions” against the US and Israel. The order stated that the US would make those involved in “offenses” against the ICC pay a price, including confiscating properties and assets, and banning ICC personnel, their agents, and direct family members from entering the United States. The very next day, the ICC issued a statement condemning Trump’s executive order. The European Union and the Netherlands also expressed regret and concern over the decision.
